Company managing our domain closed and is not responding

Company Fairweb.ca and fairwase.com who registered and maintained our domain is unreachable and the person incharge Mr. Vinod Kumar Vijayanathan Nair is also unreachable. Our domain is not responding and we need to get access to the nameservers which are setup by them.

 

Need help from godaddy to help us in regaining access. What is the legal way to go about it.

 

thanks for any help and its been many days since our mailserver, dns and all are not working.

Hi @teabeedi. Thanks for posting. The situation you are in is unfortunately fairly common. If you do not have access to the GoDaddy account the domain is in, your best option within our system would be to request the domain be moved to another account that you control. You can do that by filling out the form here. However, please note that we can only move the domain at the request of the registrant listed in the domain's WHOIS information. If you can verify that you are the registrant, then we can move the domain for you. If you can not, then you'll want to get in touch with a legal professional to see what your options are. That is the problem! This company that is defunct/gone-missing is also our registrant.

Please let us know how a legal professional can help with this!

 

We are wondering if it is possible that we show you proof that the physical address used in the webpages - that are archived - is the same as that where our company that needs the domain is registered as proof that we are the actual "owners" of the domain and then request for a conditional transfer on the condition that we will let the defunct company reclaim it if they come alive and wish to claim it back.

@teabeedi - Unfortunately I can't offer you legal advice. If you're not listed as the registrant (name or organization) then it will be difficult for you to recover the domain. If you have a trademark that applies to the domain, then you may be able to file a request on that basis. Other than that, you may need to review your contract with the provider in question to see what your options are. You can review all of our legal agreements here. Good luck!
